Death by Committee: Reviving Federal Environmental Justice Legislation to Mitigate Disproportionate Impacts on Vulnerable Communities

This Note proposes legislation that provides an avenue for protecting the right to a clean and healthy environment by requiring agencies consider vulnerable communities before initiating large-scale federal projects. Part I lays out emergence of environmental justice issues in United States, including its turning point. II introduces both successful failed attempts at analyzes why continuously fails. III dis- cusses how executive action becomes pointless overall progression examines President Biden’s progress first year his presidency. Finally, V specific language Congress should include proposed asserts congressional is correct substantive legislation. additionally compares three governing documents—the National Environmental Policy Act, Executive Order 12898, New Jersey Justice law—to this Note.
